I, Frank H. Murkowski, Governor of the State of Alaska, make the following findings concerning apprenticeship utilization for State of Alaska heavy and highway construction projects financed by the State of Alaska.
Findings
A. Well-trained construction workers in the State of Alaska are critical to the ability of the state to construct heavy and highway projects. Studies of the state’s construction work force highlight population trends that, without a concerted effort to offset them, will lead to an inadequate supply of skilled construction workers. The state regularly constructs heavy and highway projects. The efficient and economical construction of heavy and highway projects financed by the State of Alaska will be harmed if there is not an ample supply of trained construction workers in the state.
B. Apprenticeship training programs may act as an effective tool in providing training and experience to individuals seeking to enter or advance in the construction work force in this state.
Purpose
This Order is necessary to help promote a skilled construction work force within the State of Alaska. The purpose of this Order is to ensure that a skilled construction work force will be available to meet future construction project demands within the state.
Orders
Under the authority of art. III, secs. 1 and 24, of the Alaska Constitution, I hereby order the following:
1. This Order applies to all heavy and highway projects financed by the State of Alaska on or after September 1, 2005, that, at the time of contract award, the Department of Transportation and Public Facilities estimates will result in a project construction cost of $2.5 million dollars or more.
2. For those projects described in paragraph 1 of this Order, the commissioner of the Department of Transportation and Public Facilities shall strive to require that no less than 15 percent of the labor hours reported to the Department of Labor and Workforce Development be performed by apprentices in the following United States Department of Labor Standard Occupational Classification System job titles: 47-2073, Operating Engineers and Other Construction Equipment Operators; 49-3042, Mobile Heavy Equipment Mechanics, Except Engines; 49-9099.99, Lubrication Servicer-Materials Disposal Technician.
3. The Department of Transportation and Public Facilities shall coordinate with, and provide information concerning activities under this Order to, the Department of Labor and Workforce Development, including the following:
- the name of the project;
- the dollar value of the project;
- the date that the contractor is provided a notice from the Department of Transportation and Public Facilities to begin work (i.e., the “notice to proceed” date);
- the contact name and number of the contractor;
- the contact name of each sub-contractor whose name is provided to the Department of Transportation and Public Facilities by the prime contractor.
4. The Department of Labor and Workforce Development shall assist the Department of Transportation and Public Facilities by collecting and reporting the following data for each project identified:
- the actual apprentice hours worked on the project as an apprentice;
- the actual journeymen hours worked.
5. The commissioner of the Department of Labor and Workforce Development and the commissioner of the Department of Transportation and Public Facilities shall report annually to the governor on the percent of apprentice hours achieved for United States Department of Labor Standard Occupational Classification System job titles: 47-2073, Operating Engineers and Other Construction Equipment Operators; 49-3042, Mobile Heavy Equipment Mechanics, Except Engines; and 49-9099.99, Lubrication Servicer-Materials Disposal Technician.
6.In this Order, unless the context clearly requires otherwise,
- “apprentice” means an apprentice enrolled in a federally registered approved apprenticeship training program under 29 U.S.C. 50 and 29 C.F.R. 29.1 – 29.13;
- “construction” has the meaning in AS 36.30.990(6), except that “construction” does not include the services and professional services relating to planning and design required for the construction;
- “federally registered approved apprenticeship training program” means an apprenticeship training program approved by the Office of Apprenticeship Training Employer and Labor Services, United States Department of Labor, pursuant to 29 U.S.C. 50 and 29 C.F.R. 29.1 – 29.13;
- “heavy and highway” means work on highway, airport, harbor, dam, tunnel, utility, and dredging projects for the Department of Transportation and Public Facilities, awarded under AS 36.30;
- “labor hours” means the total hours of work performed by construction workers in the job titles set out in paragraph 2 of this Order who receive an hourly wage and who perform work either for the contractor or a subcontractor on a heavy and highway project; “labor hours” does not include hours worked by superintendents, owners, and workers who are not subject to prevailing wage requirements of AS 36.05.070.
Effective Date
This Order takes effect immediately.
