Administrative Order No. 30

Under the authority of Article III, Section 1 of the Alaska Constitution and AS 44.19.581 and 44.19.591 (as enacted by Chapter 174, SLA 1975), it is ordered that:

  1. There is established the Governor’s flanpower Planning Council as required under the Comprehensive Employment and Training Act of 1973 (CETA) (P.L. 93-203; 29 U.S.C. 801 et seq.). The Council shall prepare and submit to the Governor a State comprehensive manpower plan which:
    1. describes the services to be provided as performance goals and provides for the evaluation of the effectiveness of those services;
    2. assures that manpower services, including the development of job opportunities, be provided for those most in need;
    3. designs programs for occupations in which shortages exist;
    4. provides for the cooperation and participation of all state agencies providing manpower services and manpower related services in the implementation of a comprehensive marnpower service plan by local prime sponsors; and
    5. makes maximum practicable use of the planning and operational services of state government and local governments which are not prime sponsors under Title I of CETA.
  2. The membership of the Governor’s Manpower Planning Council is as follows:
    1. the Director of the Manpower Division within the Office of the Governor, who shall be a non-voting member and serve as Chairman;
    2. the Director of the Employment Security Division of the Department of Labor, who shall be a non-voting member and serve as Vice-Chairman;
    3. the Deputy Commissioner of the Department of Labor;
    4. one member of the State Board of Vocational Education;
    5. one representative from each unit or combination of units of local government as described in paragraphs (2), (3), (4) and (5) of Section 102(a) of CETA which has indicated an intention to submit a plan to become a prime sponsor under CETA; the representative will be selected by the Governor from lists submitted by the chief executive officers of each unit or combination of units of local government involved;
    6. two representatives of organized labor;
    7. two representatives of business;
    8. one representative of a community based organization;
    9. three representatives from special target groups as defined by Title 111(a) of CETA; these representatives will be selected by the Governor from lists submitted by the special target groups or a consortium of special target groups, but will not include staff members of CETA-financed programs and projects who are involved in the operation or direct ai’ninistration of those programs and projects;
    10. one member each from the Department of Health and Social Services, the Department of Community and Regional Affairs and the Department of Education; these members will not be chosen from the staff of any division under contractual agreement to perform CETA services;
    11. two representatives from the population to be served by the state as a prime sponsor under CETA; and
    12. one representative of the state’s post-secondary education system.
  3. The membership of the State Manpower Services Council created under AS 44.19.591 is as follows:
    1. the members of the Governor’s Manpower Planning Council; and
    2. six members representing other prime sponsors in the state; to be selected by the Governor from lists submitted by the chief executive officer of each prime sponsor.
  4. The Chairman of the Governor’s Manpower Planning Council shall also serve as Chairman of the State Manpower Services Council. The State Manpower Services Council shall have an executive committee consisting of the chairman and such other members as the Council may elect to serve at its pleasure. The executive committee is empowered and authorized to act for the Council in any emergency circumstance in which it determines that the exigencies of time or the unavailability or a quorum requires action pursuant to the statutes or regulations regulating manpower planning, the State Plan, or this order1 which, if not taken, would diminish the effectiveness of comprehensive manpower services in Alaska. Minutes of all Council meetings and Executive Committee meetings shall be kept and transmitted to all Council members.
  5. In addition to the duties of the State Manpower Services Council specified in AS 44.19.591(e), the Council shall:
    1. carry out all advisory responsibilities of the Governor
      relating to federally assisted manpower programs;
      these include, but are not limited to, manpower programs
      under:

      1. The Comprehensive Employment and Training Act of 1973;
      2. The Vocational Education Act of 1963;
      3. The Economic Opportunity Act of 1964;
      4. The Health Professions Education Assistance Act of 1965;
      5. The Elementary and Secondary Education Act of 1965;
      6. The Allied Health Professions Persdnnel Training Act of 1966;
      7. The Social Security Act of 1971 as amended by P.L. 93-647;
      8. The Older American Act of 1963;
      9. The National Health Planning and Development Act of 1974; and
    2. work closely with all agencies of state government to achieve the greatest possible degree of cooperation and coordination in the effective and non-duplicative utilization of the resources available to alleviate the manpower problems within Alaska, whether those resources are under the control of state or local governments, or private organizations.
  6. The Manpower Division within the Office of the Governor shall serve as the secretariat to the State Manpower Services Council and the Governor’s Manpower Planning Council. The State Manpower Services Council and the Governor’s Manpower Planning Council may establish such committees and task forces they may see fit in order to expedite the business of the councils throughout the year. The Chairman may appoint members to each committee or task force or cause them to be elected by the council membership.
  7. The Governor’s Manpower Planning Council and the State Manpower Services Council may meet jointly or separately from time to time as may seem appropriate upon call of the Chairman. The conduct of meetings of both councils shall be governed by Robert’s Rules of Order and the Chairman may appoint parliamentarians. A quorum for each council shall be one more than one-half the full membership of that council, rounded to the next higher number. All members are required to attend all meetings or to obtain excused absences from the Chairman prior to each called meeting. Members who fail to obtain excused absences for two consecutive meetings or three meetings in a year may be subject to removal by the Governor for cause.

This order is effective upon its issuance.
