Administrative Order No. 212

Findings

I, Frank H. Murkowski, Governor of the State of Alaska, make the following findings:

  1. During the period July 14, 2003, through August 3, 2003, in interior Alaska including portions of the Denali, Matanuska-Susitna and Fairbanks North Star Boroughs, unseasonably heavy rains resulted in localized flooding. The Department of Transportation and Public Facilities (DOT&PF) confirmed flooding and damage to state roads on the Parks Highway at Carlo Creek and Honolulu Creek, Elliot Highway at Milepost (MP) 26 in the Tolovana area, Copper River Highway at MP 35.9 (DOT&PF bridge no. 339) in the Cordova area, and Chena Hot Springs Road MP 37.5 and 20.1.
  2. The Department of Military and Veterans Affairs, Division of Emergency Services (DES) and DOT&PF performed a threat and damage assessment and resolution determination. This assessment found key road and highway infrastructure damage occurred in the flood area. DOT&PF determined that no emergency funding or operational funds are available for the repairs. If the essential infrastructure is not quickly repaired, serious threats to life, public health, and public safety will continue. Therefore, it is appropriate that disaster relief funds be made available to contribute to the DOT&PF’s restoration of essential infrastructure.
  3. Based on information from the joint DES and DOT&PF assessment and from the Disaster Policy Cabinet, I have determined that this incident poses a direct and imminent threat of sufficient magnitude and severity to justify state action.
  4. I find it appropriate that money from the Disaster Relief Fund (AS 26.23.300), be expended to cover the costs incurred by DOT&PF in response to this incident.

Order

Under the authority of article III, section 1 of the Alaska Constitution and AS 26.23.020(h) and AS 26.23.300(b), I, Frank H. Murkowski, Governor of the State of Alaska, hereby order that:

Consistent with AS 26.23.010 – AS 26.23.220 (Alaska Disaster Act) and AS 26.23.300(b), expenditures be made from the Disaster Relief Fund to supplement funds from other available sources to repair and replace roads and bridges on the Parks Highway at Carlo Creek and Honolulu Creek, Elliot Highway at MP 26 in the Tolovana area, Copper River Highway at MP 35.9 (DOT&PF bridge no. 339) in the Cordova area, and Chena Hot Springs Road MP 37.5 and 20.1. The amount of these expenditures is not to exceed $500,000 including administrative fees.

This Order takes effect immediately.
